Terms of Service

§ 1 Definitions

User - any natural person, legal entity, or organizational unit without legal personality who accesses and uses the Web3 Lists Platform.

Platform - the website located at web3lists.com, through which Users can access curated Twitter/X lists for crypto and Web3 communities.

Administrator - Pawnie, who operates the Platform and can be contacted at web3lists@gmail.com.

Curated Lists - collections of Twitter/X accounts organized by categories such as Kaito leaderboards, Pre-TGE projects, Post-TGE projects, Smart Followers, or other specialized categories.

Sponsor - an entity that financially supports the Platform in exchange for visibility or promotion on the Platform.

Promoted List - a Curated List that receives premium placement on the Platform through a sponsorship arrangement.

External Services - third-party platforms or services that the Platform links to, primarily Twitter/X.

§ 2 General Provisions

  1. These Terms define the rules for using the Web3 Lists Platform.
  2. By accessing or using the Platform, Users acknowledge that they have read, understood, and agree to be bound by these Terms.
  3. The Platform provides access to Curated Lists of Twitter/X accounts in the cryptocurrency and Web3 space, organized by various categories, along with search queries for filtering content.
  4. In matters not regulated by these Terms, generally applicable provisions of international law shall apply.

§ 3 Rules of Platform Use

  1. The Platform is available to all Users without requiring registration or creating an account.
  2. To use the Platform effectively, the User should have a device with internet access and a current web browser with JavaScript and cookies enabled.
  3. Users are prohibited from:
    • Providing content of an unlawful nature
    • Acting in a manner that violates the law or aims to circumvent the law
    • Using the Platform in a way that disrupts its operation or is burdensome to the Administrator or other Users
    • Attempting to reverse engineer, decompile, or modify any aspect of the Platform
  4. The Administrator reserves the right to block access to the Platform to Users who violate these Terms.

§ 4 External Links and Third-Party Content

  1. The Platform contains links to External Services, particularly Twitter/X, and the Administrator is not responsible for the content or practices of those External Services.
  2. Clicking on external links will redirect Users to services not controlled by the Administrator, which operate under their own terms of service and privacy policies.
  3. The Administrator is not responsible for the accuracy, quality, or reliability of content on the linked External Services.
  4. The Administrator does not guarantee the continuous availability of External Services linked from the Platform.

§ 5 Intellectual Property

  1. The Platform, including its design, arrangement, content, features, and functionality, is owned by the Administrator and is protected by intellectual property rights.
  2. Users may not copy, modify, distribute, sell, lease, or create derivative works based on the Platform or its content without explicit permission from the Administrator.
  3. The Administrator does not claim ownership of Twitter/X account information and lists, which remain subject to Twitter/X's terms of service and applicable laws.

§ 6 Sponsorship and Promoted Content

  1. The Platform may display Sponsors and Promoted Lists, which are clearly marked as such.
  2. The presence of a Sponsor or Promoted List does not constitute an endorsement by the Administrator of any project, token, or investment opportunity.
  3. Entities interested in sponsoring the Platform or having their lists promoted should contact the Administrator directly.
  4. The Administrator reserves the right to refuse sponsorship from any entity at their sole discretion.

§ 7 Disclaimer of Investment Advice

  1. The Platform is for informational purposes only and does not provide investment, financial, or trading advice.
  2. No content on the Platform should be interpreted as investment advice, recommendation, or endorsement of any project, token, or cryptocurrency.
  3. Users acknowledge that cryptocurrency investments involve significant risk, including the potential loss of the entire investment.
  4. Users are solely responsible for their investment decisions and should conduct their own research before making any investment.

§ 8 Liability Limitations

  1. The Administrator provides the Platform on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
  2. The Administrator does not guarantee that:
    • The Platform will be available uninterrupted or error-free
    • External links will remain active and unchanged
    • Information on the Platform will be complete, accurate, or up-to-date
  3. The Administrator shall not be liable for any damages arising from:
    • Use or inability to use the Platform
    • Reliance on information obtained from the Platform
    • Investment decisions made based on information from the Platform
    • Actions of External Services linked from the Platform
  4. The Administrator's total liability for any claims related to the Platform shall not exceed $100.

§ 9 Privacy and Data Protection

  1. Information about how the Administrator collects, processes, and protects User data is described in the Privacy Policy, which forms an integral part of these Terms.
  2. By using the Platform, Users acknowledge that they have read and understood the Privacy Policy.

§ 10 Changes to Terms

  1. The Administrator reserves the right to modify these Terms at any time.
  2. Changes to the Terms will be announced on the Platform.
  3. Continued use of the Platform after any modifications to the Terms constitutes agreement to the updated Terms.

§ 11 Final Provisions

  1. These Terms are effective as of March 17, 2025.
  2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  3. The Administrator may transfer rights and obligations under these Terms to a third party without notifying Users.
  4. These Terms shall be governed by and construed in accordance with international law.
  5. Any disputes arising from these Terms or the use of the Platform shall be resolved through negotiation. If negotiations fail, the dispute shall be resolved by a court of competent jurisdiction.
